The “Notice of Interest” should be used in addition to the Real Estate Purchase Agreement. It is a legal document recorded at the county courthouse to publicly declare a party’s interest in a specific piece of real estate. This notice serves to protect their contractual right to purchase the property by notifying others of their interest. By recording the Notice of Interest along with a copy of the Real Estate Purchase Agreement as Exhibit A, the buyer effectively prevents the seller from transferring or encumbering the property without resolving the buyer’s claim. This protects you from another buyer trying to circumvent your existing contract and close on the property.
